In the month of June 2008, the Department of Energy (DOE) submitted an application to the Nuclear Regulatory Commission for a license to build the permanent repository. Yucca Mountain is located 90 miles northwest of Las Vegas, Nevada. The Nuclear Waste Policy Act of 1982 requires utilities which generate electricity using nuclear power to pay a fee of one tenth of one cent ($0.001) per kilowatt-hour into the Nuclear Waste Fund.
